1. Definitions
"LUXFARE" refers to the entity operating luxfare.eu. "Client" refers to anyone making a booking. "Partner" refers to the transport operator performing the service. "Service" refers to the luxury transport brokered through the platform.
2. Nature of the service
LUXFARE operates as a marketplace, brokering the relationship between Client and Partner. Each journey is performed by an independent, fully licensed and insured Partner. LUXFARE retains a commission on each transaction.
3. Bookings
A booking is deemed accepted once LUXFARE sends an email confirmation. The Client is responsible for the accuracy of data provided (times, locations, passengers).
4. Payment
Payment is processed securely via Stripe. We accept Visa, MasterCard, American Express, Apple Pay, Google Pay and MB Way (Portugal). The amount is charged upon booking confirmation unless otherwise stated.
5. Cancellation and refund
Cancellations more than 24 hours in advance: full refund. Between 24 and 6 hours: 50% refund. Less than 6 hours or no-show: no refund. If LUXFARE or the Partner cancels, a full refund is issued.
6. Liability
LUXFARE is responsible for proper brokerage and for upholding platform quality standards. Liability for the physical execution of transport rests with the Partner, duly insured under Portuguese law. LUXFARE is not liable for delays due to force majeure, weather, abnormal traffic or third-party acts.
7. Client conduct
The Client agrees to behave appropriately during the service. LUXFARE and the Partner reserve the right to refuse or interrupt the service in case of abusive behaviour, without refund.
8. Intellectual property
All website content (text, images, code, brand) is owned or licensed by LUXFARE and protected by Portuguese and European intellectual property law.
9. Governing law and jurisdiction
These terms are governed by Portuguese law. Any dispute is subject to the Lisbon Judicial Court, with express waiver of any other. Clients may also use the EU online dispute resolution platform (ec.europa.eu/consumers/odr).
